Abstract

Domae(盜賣[盜買], fraudulent conveyance) particularly refers to the conduct that makes the other party believe a property owned by someone else to be his own. The most frequently used scheme in fraudulent conveyance is to forge documents in order to transfer someone else’s property. The perpetrator also could purchase a property by forging documents. This paper introduces a fraudulent conveyance litigation of Dokrakdang clan of Yeoju Yi(驪州李氏) family in 18C Joseon Dynasty. Particularly, this papers discusses and analyze the legal concept of the Domae. It is a criminal crime stipulated in the Penal Code. However usually the Domae cases were treated as civil law and civil procedural issues. The judicial process concerning this litigation seems fair and just. On the other hand, the process is reflection of the declination of their social status. Perpetrators very often committed the Domae wrongfully using their own of other’s social power.
